SAPHE PRIVACY NOTICE 


Introduction 

SAPHE cares about the information privacy, security, and safety of your personal information. We take our responsibility to protect your personal information seriously. This Notice explains how we collect, use, share and protect your personal information, as required by the Protection of Personal Information Act (POPIA). 

 

The meaning of processing your personal information 

Personal Information and Special Personal Information (specifically relating to minors) is any information relating to an identifiable living or juristic person. Some examples are race, gender, marital status, nationality, age, physical or mental health, disability, language, education, identity number, telephone number, email, postal or street address, biometric information and financial, criminal or employment history. 

Process/Processing means any operation or activity, whether automated or not, concerning both personal information and special personal information, including collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation, use, dissemination by means of transmission, distribution or making available in any other form, merging, linking, as well as blocking, degradation, erasure or destruction of information. 

 

Who Are We: 

SAPHE is voluntary association of registered private higher education institutions formed to provide a working platform for addressing common needs and interests including the promotion of a level and conducive operating environment in higher education in South Africa, increasing understanding of the private higher education community within the overall education sector and participating in all processes that will influence the development of the sector.  

 

Why we need to process your personal information 

We need to process personal information in order to 

  • Create a platform to facilitate a basis for sharing common ideas and strategies in the interest of PHE, 
  • Develop strategies and initiatives to promote the role and interest of PHE in SA, 
  • Develop a network of support and alignment with regulatory authorities and business to facilitate the continuous role of PHE, 
  • Influence statutory and other regulatory processes to enhance the position and role of PHE, 
  • Engage and develop the relationship with USAF to contribute to the development of practical collaboration initiatives with Public HE in the interest of a productive HE system in SA, 
  • Support the development of the capacity of PHE to grow its role and impact in SA and beyond. 

 

When we need to share your personal information 

We may share your personal information with other service providers. 

  • These are some examples of when we will share your personal information: 
  • When it is required by any regulatory authority, such as SETA. 
  • When it is required by legislation or any legal process. 
  • To protect and defend our rights and property, including our intellectual property. 
  • When you have given us direct permission to do so. 
  • We will never sell your personal Information or share it with other parties for their own marketing use, unless you have given us direct permission to do so. 

 

Information that is automatically collected 

When you use any of our digital channels such as websites and apps, we obtain and store information generated by your activities (usage data gathered by cookies), and other information that is automatically collected from your browser or mobile device. Most of this data is not personally identifiable. However, some of it, either alone, or when linked with other information, may allow your identity to be discovered. We treat this combined data as personal information, and we protect it accordingly. 


How we protect your personal information 

We take every reasonable precaution to protect your personal information and information integrity and confidentiality on activities resulting in loss, damage, theft, unauthorised access, and destruction. Our information security controls apply generally accepted information security practices and procedures to maintain an appropriate level of personal information confidentiality, integrity, and availability... 

 

Your Rights 

The PoPIA Act has made provision for rights with regards to the lawful processing of your information and SAPHE has made provision to exercise such rights if required. You may exercise the following rights: 

  • Right to Accurate and correct PI 
  • To request access to copies of your information 
  • To request correction of your personal information 
  • To object to or request the restriction of the processing of your personal information
